George Allen has been locked up for about three decades for the brutal rape and murder of court reporter Mary Bell in 1982.

But a campaign to prove his innocence has convinced Cole County Judge Daniel Green that he didn't get a fair trial, and tomorrow -- barring a procedural move from the Missouri Attorney General -- he'll finally go free, at age 56.

Attorney Ameer Gado of the Bryan Cave law firm, one of several lawyers who've worked to exonerate Allen, tells Daily RFT that Judge Green announced his intention last Friday to release Allen on his own recognizance pending the final resolution of the case.
It was Judge Green who'd ruled on November 2 to overturn Allen's conviction. Last week, Circuit Attorney Jennifer Joyce declined to refile charges against Allen, pointing out that a key witness has since died. The attorney general, however, decided to appeal.

Barry Scheck of the Innocence Project, a non-profit that assisted Allen in his legal battle, called the AG's appeal "wholly without merit and just cruel."  

Ameer Gado of Bryan Cave says it's all but certain Allen will walk out of prison tomorrow. "I suppose the attorney general could still try to do some procedural move to delay or stop it," he says. "But it doesn't look they're going to at this point."

Gado says he hasn't spoken to Allen since last week, when he sounded thrilled -- yet cautious.

"At this point," Gado says, "it's been such a long road. He really doesn't want to let himself believe until he sees it."

Tomorrow, he might see it -- and believe it.
